TERMS & CONDITIONS OF SERVICE
Terms & Conditions
The flowing terms & conditions are adopted by all customers and clients of Watchet Cabs upon booking and will apply to all taxis/minicabs as arranged on the customer’s behalf through Watchet Cabs or any of its designated partners.
PHV is defined as “Private Hire Vehicle” and is used interchangeably with “Taxi” and relates to a licensed minicab.
HV is defined as “Hackney Vehicle” and is used interchangeably with “Taxi” and relates to a licensed hackney taxi.
Fixed pricing is defined as a pre-agreed price for a specific journey and vehicle type, subject to stated terms and conditions.
All taxi requests through Watchet Cabs for a private hire booking must be booked in advance and are subject to availability.
Watchet Cabs Hackney Carriage Vehicles can be flagged down or hired at the roadside subject to West Somerset Licensing’s’ own regulations.
We will send the requested vehicle type to meet you at the pre-defined pick up points, according to the time specified on your booking. All bookings include a standard 5-minute waiting time; thereafter all bookings are subject to waiting time charges dependant on vehicle type. All queries should be made at the time of booking so as to avoid any subsequent disagreements.
All airport transfer requests through Watchet Cabs must be booked in advance and are subject to availability. We will send the requested vehicle type to meet you at the pre-defined pick up points, according to the time specified on your booking. All airport pickups include a standard 30-minute waiting time; thereafter all bookings are subject to waiting time charges dependant on vehicle type. Airport pickups are subject to vehicle parking charges and will be charged accordingly.
All airport pickups must be paid in advance in full prior to vehicle dispatch unless otherwise agreed. All queries should be made at the time of booking so as to avoid any subsequent disagreements.
Fixed pricing agreement
A fixed price maybe offered subject to availability for particular journeys, charges relate to the vehicle type and travelling distance. Fixed prices are not charged in accordance with out standard metered tariffs and must be agreed at the time of booking so as to avoid any subsequent disagreements. Fixed priced journeys must not deviate from the driver’s chosen route; any deviation could result in the journey reverting to a fare decided by consultation with Watchet Cabs. Such consultation with Watchet Cabs will decide on any further charges according to any additional mileage and delay caused by the passenger or by the prevailing traffic conditions as a result of deviations.
Luggage and child-seat arrangements
We assume that each passenger will have no more than 1 medium suitcase and 1 piece of hand luggage 56 cm (H) * 45 cm (W) * 25 cm (D) (approximately 22 inches x 17.5 inches x 9.85 inches), Additional luggage requirements must be communicated at the time of booking so as to ascertain a suitable vehicle type and avoid any subsequent disagreements. Any luggage that a PHV or HV cannot accommodate is the responsibility of the passenger. Watchet Cabs does not provide child-seats, although passengers can provide their own and use them at their own responsibility.
In accordance with national guidelines (www.gov.uk/child-car-seats-the-rules/when-a-child-can-travel-without-a-car-seat), children under 3 years old must only travel in a rear seat with the correct child restraint and be accompanied by a parent or guardian. Children older than 3 but younger than 13 must only travel in a rear seat, wearing either a seat belt or correct child restraint. Watchet Cabs have a duty to safeguard young or vulnerable passengers, arrangements for children travelling without a parent or guardian must be communicated at the time of booking, failure to do so could result in denial of service.
Watchet Cabs cannot be held responsible for any loss financial, professional, missed connection times, flights, trains due to the PHV or HV not arriving at the pick-up points at the booked time due to unforeseen circumstances, including; adverse weather, traffic conditions, road traffic accidents or road closures or being given the wrong booking information. However, subject to status, Watchet Cabs when possible will seek to limit any loss and may provide additional travel arrangements or a refund, subject to stated terms and conditions.
Cancellation & refunds
Cancellations must be communicated directly to Watchet Cabs at the earliest possible opportunity and not through third parties, including taxi drivers. If a booking is not cancelled and a driver arrives at a pickup point, a charge may be incurred subject to consultation with the driver.
A full refund will be given for journeys paid in advance provided that the cancelation is processed at least 24 hours before the booking is due to take place. A refund of 50% of the booking cost will be refunded if cancelled between 24 hours and 6 hours of the booked time. Cancellations within six hours of a booking will not be refunded. All refund requests must be communicated directly to Watchet Cabs at the earliest possible opportunity and not through third parties, including taxi drivers. Refunds due to you to for cancellations or complaints will be made to the card used to make the original payment within 5 business days (business days being Monday to Friday).
There are no additional charges associated with using a debit, credit or smart payment service (Apple, Google pay etc.).
Fouling or damage of Vehicles
Any fouling of the PHV or HV by any passenger will result in a charge of a minimum of £75.00, depending on the severity of the fouling. Watchet Cabs and subsequent self-employed drivers will prosecute any person who causes damage to any vehicle booked through or arranged through Watchet Cabs.
Right of refusal
The driver has the right to refuse access to the vehicle, any passenger that they suspect to be acting unlawfully, who is or appears to be intoxicated either by alcohol or other substances whether legal or illegal, or who they feel may pose a threat to him/her or the vehicle.
Use of Website and Web booking Terms & Conditions
Anyone booking a taxi or minicab or any vehicle through this site will agree to the terms and conditions stated below. Anyone carrying out a booking for another person, will represent that they carry the authority of that individual to accept the terms and conditions on their behalf.
In these terms and conditions, the following phrases carry the following definitions:
2.1 The ‘Company’ is Watchet Cabs
2.1.1 The ‘agreed pick up point’ is the stated place where you will be picked up, in accordance with the terms and conditions.
2.1.2 The ‘agreed time’ is the stated time and date when you will be picked up, in accordance with the terms and conditions.
2.1.3 The ‘booking’ is the booking of our company’s services for your trip. It is possible to place a booking for a single trip, a return trip or split trips.
2.1.4 The ‘supplier’ will refer to the private hire taxi company that the booking has been placed with.
2.1.5 The ‘suppliers terms and conditions’ or ‘suppliers T&Cs’ refer to the terms and conditions of the supplier, which are over and above the terms that relate to the booking and governance of the trip.
2.1.6 The ‘card’ refers to the debit, charge or credit card or any contactless payment method that has been used in making the booking.
2.1.7 ‘Cash’ refers to a payment which has been made to the supplier or driver.
2.1.8 ‘Card costs’ relate to charges which have been incurred through using services of credit card companies when making payment for services.
2.1.9 The ‘details’ refer to the information and details provided by you when making a booking.
2.1.10 The ‘fare’ relates to the fee that is paid with respect to the accepted quote.
2.1.11 The ‘goods’ refers to any or all goods that are present in the vehicle during a journey or booking.
2.1.12 The ‘trip’ refers to the journey which runs from the agreed pick up point to the state drop-off point.
2.1.13 The ‘licencing authority’ refers to any or all regional/national licencing authorities who hold responsibility for licencing the operation of relevant firms.
2.1.14 ‘Particular requirements’ relates to any requirements that you may have with respect to the gender of the driver, access to any disabled facilities or any other issue.
2.1.15 The ‘passenger’ relates to anyone travelling in the vehicle who is not the driver.
2.1.16 ‘Personal data’ refers to any or all data provided by you in making a booking and this can include email addresses, physical addresses, card details and telephone numbers.
2.1.17 The ‘quote’ relates to the fixed price that is provided to you on booking the trip.
2.1.18 The ‘terms’ relate to the terms and conditions between you and the site.
2.1.19 ‘You’ relates to the person that has provided details to the company and has made the booking.
Use of the site
3.1 Anyone wishing to make a booking through this site will need to provide accurate details and you are responsible for any issues arising from a failure to provide accurate information.
3.2 You state that you are at least 18 years old and legally allowed to undertake the booking.
3.3 We provide no guarantee that your requirements will be fulfilled and we reserve the right to refuse any bookings. We reserve the right to cancel bookings and provide full or partial settlement to any claims you may have on the fees paid by you.
3.4 Data and details relating to your use of this site will be recorded but your personal data will not be.
4.1 When you provide details relating to the trip, we will aim to provide you, via this site, with a quote that fulfils your requirement.
4.2 You are responsible for ensuring your details are correct. When making a booking, it is an offer which may or may not be accepted and your booking will not be confirmed until the confirmation screen is displayed on site.
4.3 All bookings made are dependent on the terms and conditions of the supplier.
4.4 There is no guarantee that any or all accommodations of the user will be met and if you have particular requirements, you are advised to make alternative arrangements to ensure your particular requirements are met.
4.5 This site reserves the right to alter or change any/all typographical errors found on site and this includes pricing errors. Once errors have been noted and changed, you will be informed of any error and if you wish to withdraw your offer and not go through with the booking, you have the right to do so and you will be entitled to a full refund.
4.6 For bookings where a pre-payment is made by card, the supplier has the right to collect all of the money due for the trip, and settle all card costs, in advance of the trip.
4.7 With respect to the fulfilment of the booking, the supplier holds the right to transfer the contract to another party to ensure the booking is effectively fulfilled.
Website Booking Payment
5.1 When making a booking with Pay By Card option, you agree to pay the fare at the point and time of booking.
5.2 Once your booking has been confirmed on the payment screen, the booking cannot be changed or cancelled except from accordance with Clause 7 of these supplied terms.
5.3 If you attempt to pay by card and your card payment is refused by the card issuer, your booking will not be fulfilled.
5.5 Payment does not provide cover for additional requirements that may be needed, such as a child seat, which should be requested in advance. If there is no advance warning or notification of additional luggage, resulting in the need for a larger vehicle, you may be charged extra, and this must be paid directly at this point. Any user that wishes to tip the driver will do so at their own discretion.
5.6 If you wish to deviate from the provided route which was entered on the site, you may be subjected to additional fees.
6.1 The company isn’t insured for loss or damage sustained during the journey and you are responsible to unsure goods, for any loss or damage, for the trip.
Cancellation of bookings and refunds
7.1 You retain the right to cancel any bookings made via the site Subject to the Terms and conditions stated on the Terms & Conditions of Carriage.
Warranty and limitation of liability
8.1 The company holds the appropriate licences from the appropriate licencing authority and further verification can be obtained by contacting the private hire firm.
8.2 The company is not be liable for any delays relating to pick up or drop off points or for the failure to arrive or the failure of any provision or services in line with your expectations.
8.3 The company will not be liable for any consequential or indirect loss or loss of revenue suffered by you relating to any failure of the supplier. If you hold that you have a claim with respect to any failure of the firm, you agree to carry out your claim against the supplier directly. Regardless, the total liability of the firm will be limited to £500.
8.5 There is nothing contained within this clause which will exclude your rights with respect to consumer legislation. There is also nothing contained within this clause will limit the liability of the company for death or personal injury related to negligence.
8.6 All stated trip times and arrival times are stated as indicative. You are responsible for arranging a suitable agreed time that ensures you will arrive in good time.
